Terms and Conditions of Tour Service

Article 1 (Purpose) The purpose of these Terms and Conditions (hereinafter referred to as the "Terms") is to define the rights, obligations, and responsibilities between the travel agency, Seoul to the Five LLC (hereinafter referred to as the "Company"), and the traveler (hereinafter referred to as the "Traveler") concerning the use of New York area tour and travel services (hereinafter referred to as the "Services") provided by the Company.

Article 2 (Formation of Contract and Payment)

  • The travel contract is formed when the Traveler books a tour package/service and completes the payment of the required deposit or full tour fee.

  • Payments shall be made via credit card, debit card, or other electronic payment methods approved by the Company.

Article 3 (Cancellation and Refund Policy) In the event of a reservation cancellation or refund request due to reasons attributable to the Traveler, the following refund schedule applies based on the tour start time (local New York time, EST/EDT):

  • Up to 7 days (168 hours) prior to tour start: 100% Full Refund (credit card processing fees may be deducted where applicable).

  • 6 days to 3 days (72 hours) prior to tour start: 50% Refund of total payment.

  • 2 days to 24 hours prior to tour start: 20% Refund of total payment.

  • Within 24 hours of tour start or No-Show: Non-Refundable (0%).

  • Refund Processing Period: Approved refunds will be processed back to the original method of payment within 7 to 14 business days from the date of refund approval.

Article 4 (Special Provisions on Admission Tickets and Included Items)

  • Pre-issued tickets—including observation decks (Empire State Building, Top of the Rock, SUMMIT One Vanderbilt, etc.), ferry tickets, museum/art gallery passes, and Broadway musical tickets—are strictly non-refundable once issued, regardless of the cancellation timelines in Article 3.

  • When a package tour is canceled, the actual cost of pre-issued tickets will be deducted first, and the refund policy in Article 3 will apply to the remaining balance.

Article 5 (Cancellation by the Company & Minimum Group Size)

  • If the minimum number of participants required for a group tour is not met, the Company may cancel the tour by notifying the Traveler at least 48 hours prior to the tour start time.

  • In case of cancellation due to failure to meet the minimum group size, the Company will issue an immediate full refund of the total amount paid.

Article 6 (Force Majeure and Itinerary Adjustments)

  • If tour operation becomes impossible due to force majeure events—including severe weather conditions (blizzards, hurricanes, etc.), road closures, strikes, demonstrations, or government orders—the Company will either cancel the tour with a full refund or reschedule upon mutual agreement.

  • Due to unexpected traffic congestion or local weather changes during the tour, portions of the itinerary or their sequence may be adjusted as directed by the guide.

Article 7 (Traveler Obligations and Safety Guidelines)

  • The Traveler must strictly observe the designated meeting time and location. Failure to arrive on time will be treated as a No-Show.

  • The Traveler assumes full responsibility for any loss, theft, or personal accident resulting from individual unauthorized actions during group tours.

  • Minors (under 18 years of age) must be accompanied by a legal guardian.

  • Travelers are strongly advised to purchase comprehensive travel/medical insurance prior to departure to cover medical emergencies and unexpected incidents in the United States.
